Your use of the website at https://Allweber.com/ and any related services provided by Allweber is subject to these Terms of Service.

You agree to obey these Rules of Service and all applicable laws and regulations when using Allweber. You are not permitted to use or access this website or utilize any other services provided by Allweber if you do not accept these Terms of Service.

We reserve the right to review and change any of these Terms of Service at our discretion. We’ll update this page after we’ve done so. From the date of publication, any modifications to these Terms of Service will take effect.

These Terms of Service were last updated on 26 July 2022.

Limitations of Use

You warrant that you will not: (1) misuse this website; (2) abuse this website; and/or (3) break any applicable laws.

  • modify, copy, decompile, or reverse engineer any of the materials or software on this website;
  • Any materials and software on this website should have any copyright or other proprietary notations removed.
  • transfer the data to another person, or “mirror” it on a different server;
  • Use this website or any of its associated services in a manner that abuses or disrupts our networks or any other service Allweber provides, whether knowingly or negligently
  • Any harassing, indecent, obscene, misleading, or unlawful material may be transmitted or published using this website or its associated services.
  • You may not use this website or its linked services to break any applicable laws or orders;
  • To send unlawful advertisements or spam, you may use this website;
  • Harvest, collect, or gather user data without the user’s consent;
  • Infringe on the privacy, intellectual property rights, or other rights of third parties by using this website or its associated services in a manner that is prohibited.

Intellectual Property

Allweber owns or licenses the intellectual property in the elements on this website, which is protected by copyright and trademark legislation. For personal, non-commercial transitory usage, we grant our users permission to download one copy of the materials.

This is not a transfer of ownership, but a grant of permission. This license will automatically expire if you breach any of the stipulations of the Terms of Service, and Allweber has the right to terminate it at any time.

Liability

We provide our website and the contents on its “as is” basis. Allweber makes no warranties, expressed or implied, and expressly disclaims and nullifies all other warranties, including but not limited to implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property.

Under no circumstances will Allweber or its suppliers be held accountable for any consequent damage done to you or a third party, even if an authorized representative has been notified orally or in writing of the possibility of such damage.

Any consequential loss, indirect loss, actual or anticipated profit loss, loss of benefit, loss of revenue, business failure, goodwill failure, opportunity failure, data failure (including negligence), or any other form of economic harm is referred to as a “consequential harm” in this context.

These limitations may not apply to you since some countries do not allow limitations on implied warranties or liability for consequential or incidental damages.

Accuracy of Materials

The information on our website is not comprehensive, and it is intended for educational purposes only. The precision, likely effects, or dependability of the usage of such content on this website, or otherwise concerning such content or any links to this website, is not guaranteed by Allweber.

Subscriptions

Several parts of the Service are subscription-based (“Subscriptions(s)”). You will be charged in advance on a recurring and periodic basis (“Billing Cycle). Your billing cycles are set to either monthly or yearly depending on the type of subscription plan you choose when subscribing.

Unless you cancel or Allweber cancels your Subscription, it will automatically renew at the end of each Billing Cycle. Either through your online account management page or via the Allweber support team, you may cancel your Subscription renewal.

To process your subscription payment, you must use a valid payment method, such as a credit card. You must give accurate and comprehensive bill information to Allweber, including full name, address, state, zip code, telephone number, and acceptable payment method information. You consent to Allweber charging all Subscription costs incurred via your account to any such payment instruments by providing such payment information.

Free Plan

Allweber has the right to provide a Subscription for a limited time (“Free Plan”) at its sole discretion.

Fee Changes

Allweber reserves the right to change the Subscription charges at any time and in its sole judgment. At the end of the then-current Billing Cycle, any Subscription fee change will take effect.

To allow you enough time to terminate your Subscription before such change becomes effective, Allweber will provide you with reasonable notice of any change in Subscription fees.

Your consent to pay the revised Subscription fee amount will be evidenced by your continued use of the Service after the Subscription fee increase.

Links

Allweber is not responsible for the contents of any of the websites linked to its website and has not reviewed them all. Allweber does not endorse, approve, or control any of the sites that have been included in this article. We strongly advise you to make your investigations as to the suitability of any such linked site before using it.

Right to Terminate

Upon written notice to you for any breach of these Terms of Service, we may suspend or terminate your right to use our website and/or these Terms of Service.

Severance

To the extent that a provision of these Terms of Service is void or unenforceable, it is severed. The remaining parts of these Terms of Service remain valid.

Governing Law

The laws of the United Kingdom govern and construe these Terms of Service. You give up your right to appeal to the courts in that state or territory for a review of your case.

Acceptable Use Policy

The goods, services, and technologies (collectively referred to as the “Goods”) provided by Allweber under any continuing contract are covered by this acceptable use policy. It is intended to keep unethical, imprudent, and illegal acts away from us, our consumers, and the rest of the Internet community.

Customers who engage in activities that are prohibited by the acceptable use policy may face service suspension and account termination. We may be legally bound to notify such consumers to the relevant authorities in severe situations.

Fair use

We assume that your users will be “business as usual,” as per our offer schedule when we provide our facilities. Further charges or capacity limitations may be imposed if your use is judged to be excessive.

We strongly oppose any kind of abuse, prejudice, rights infringement, and/or harmful or disadvantageous behavior against any group, person, or resource. Our consumers and, if applicable, their end-users (i.e., users) are expected to use our Products with a similar purpose.

Customer accountability

We believe that our consumers are responsible for both their actions and the actions of persons who use our Products with their permission. Anybody who uses our Products in violation of the law as a consequence of the customer’s failure to implement reasonable security measures is also subject to this obligation.

Our customers agree to ensure compliance with this policy on behalf of anyone who uses the Products as their end-users by purchasing from us. Complaints about customers’ or end-users behavior will be sent to the account in question’s designated contact.

We reserve the right to terminate any Products associated with the offending account or the account itself, as well as take any remedial or preventative action we deem appropriate, without notice, if a customer — or their end-user or anyone using our Products as a result of the customer — violates our acceptable use policy. No service interruption due to any breach of our acceptable use policy will be eligible for credit, subject to applicable law.

Prohibited activity

Copyright infringement and access to unauthorized material

Any illegal material may not be transmitted, distributed, or stored using our products. This includes, but is not limited to:

  1. any copyrighted, trademarked, trade secreted, or other intellectual property-protected information used without the owner’s consent.
  2. Any obscene, defamatory, or illegal threat material is prohibited.

All material submitted, uploaded, disseminated, transmitted, produced, or published via or on our Products is the sole responsibility of the user. The user must also obtain legal permission to use such works.

SPAM and unauthorized message activity

Our goods may not be deployed to send unsolicited bulk or commercial communications in violation of the rules and norms that apply to your jurisdiction (“spam”). Sending spam, requesting clients from spammers who use other service providers, and collecting responses to spammers who use other service providers are all examples of this.

Running unverified mailing lists or phone number lists (“messaging lists”) is prohibited by our products. Storing any email addresses or phone numbers subscribed in this manner, as well as subscribing email addresses or phone numbers to any messaging list without the permission of the owner. All “confirmed opt-in” messaging lists must be operated or hosted by our products. For the lifetime of the messaging list, the address or telephone number of the owner must be verifiable, and his or her permission must be granted.

With our Products, we ban the usage of email lists, phone number lists, or databases acquired from third parties for spam or unconfirmed communication list reasons.

Messages transmitted via our Services, or messages directed by the customer or any individual on the customer’s behalf to a recipient who is directed to a website hosted via our Services, are subject to this spam and unauthorized message activity policy.

Unethical, exploitative, and malicious activity

Any software, program, product, or service intended to violate this acceptable use policy or the acceptable use policy of other service providers may not be used for advertising, transmitting, or otherwise making available. Facilitating the introduction of network sniffing, pinging, packet spoofing, flooding, mail-bombing, and denial-of-service attacks are examples of things that aren’t covered by this.

Our goods must not be used to unlock any account or electronic resource where the individual or group attempting to unlock it does not own or has not been granted permission to unlock the account (e.g., “hacking,” “cracking,” “phreaking”).

Our products must not be used to introduce viruses or harmful code into our systems to do so.

Our goods must not be utilized for harassing another group or individual, whether on purpose or not. Denial-of-service assaults, hate speech, promotion of racial or ethnic intolerance, and any action aimed to intimidate, mistreat, violate the rights of, or discriminate against any group or person are all examples of harassment under our definition.

Other activities considered unethical, exploitative, and malicious include:

  • To avoid payment, obtain (or try to obtain) services from us.
  • To avoid payment, we used our resources to obtain (or endeavor to obtain) services from another provider.
  • Any unauthorized access, change, or deletion (or any attempt thereof) of our customers or end-users information;
  • By interfering with other customers or authorized individuals’ use of our facilities and network;
  • Providing or sharing any material that promotes violence, portrays a violent act, portrays child pornography, or threatens anyone’s life and safety;
  • Any act or omission in violation of consumer protection laws and regulations;
  • Any violation of a person’s privacy.

Any individual or entity involved with or suspected of involvement in unlawful gambling; terrorism; narcotics trafficking; arms trafficking; or the development, manufacture, stockpiling, or use of nuclear, chemical, or biological weapons, as well as others who assist in the financing of such activities or causes, may not use our goods.

Unauthorized use of Allweber property

To fraudulently gain service, custom, patronage, or trust, we prohibit Allweber’s impersonation, representation of a significant business relationship with Allweber, and ownership of any Allweber property (including our Products and brand).
